Terms of Service

1. What chat4000 is

chat4000 is a client application published by NeonNode Ltd ("we," "us"), a company registered in Hong Kong. It's a messaging interface and transport service that lets you send and receive messages with an AI agent host ("Plugin") that you install and run on a system you control. Messages are routed through our relay server, end-to-end encrypted between your devices. We cannot read them.

chat4000 does not include an AI model. The AI that responds to you is third-party software you run yourself. We do not train, host, fine-tune, or control that AI. We do not execute actions on your system. The Plugin you install does that, under permissions you grant it.

You are responsible for the AI model you connect to, the Plugin you install, the systems you grant the Plugin access to, the prompts you send, and the actions you approve.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use chat4000 for its intended purpose. You may not reverse-engineer chat4000, resell it, or use it in violation of applicable law or these Terms.

3. Your responsibilities

• You are at least 18 years old.
• You will not use chat4000 for any unlawful purpose; to harass others; to generate content that sexually exploits minors; to develop weapons; to access systems you are not authorized to access; or to violate the terms of any third-party service the Plugin interacts with on your behalf.
• You will review AI-generated outputs and proposed Plugin actions before relying on them or approving them.
• You will not use chat4000 for medical diagnosis, legal advice, financial decisions, safety-critical systems, or any use where an error could cause harm to life, health, or property.
• You are responsible for backups of any system or data the Plugin can affect.
• You are responsible for the security of your devices and for the confidentiality of any pairing codes or credentials you share.

4. The AI and the Plugin are not our software

The AI model and the Plugin are not chat4000. They are separate software operated by you or by third parties. We are not responsible for:

• Outputs generated by the AI
• Actions taken by the Plugin on your system or on third-party systems
• Data loss, file corruption, system misconfiguration, or service disruption caused by the Plugin
• Errors, outages, bias, harmful content, or unsafe behavior of the AI model
• Terms or availability of third-party models, services, or plugins you choose to use
• If you connect chat4000 to a relay, AI model, or Plugin we don't operate, our responsibility ends at the boundary of chat4000 itself.

5. The relay

When you use our relay, chat4000 transmits encrypted messages between your device and your Plugin. We do not inspect, moderate, or modify message content. Messages are end-to-end encrypted and we cannot read them. Undelivered messages are queued in encrypted form for up to 7 days and then deleted. We do not guarantee delivery, latency, or availability.

6. No warranty

chat4000 is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that chat4000 will be uninterrupted, secure, or error-free, that message delivery will be timely, or that any AI output or Plugin action will be accurate or safe.

This section does not exclude warranties or rights that cannot be excluded under applicable law.

7. Limitation of liability

To the maximum extent permitted by law, our total liability to you for all claims arising out of or relating to chat4000 is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) US$50.

We are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, goodwill, or business.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, gross negligence or willful misconduct, or any liability that cannot be excluded under applicable law.

8. Indemnification

You agree to defend and indemnify NeonNode Ltd against any claim brought by a third party arising from your prompts, your use of the AI model, actions taken by the Plugin under your direction, or your violation of these Terms.

9. Changes

We may update these Terms. If changes are material, we will notify you through the app, and you may be asked to accept the new Terms to continue using chat4000.

10. Governing law and disputes

These Terms are governed by the laws of Hong Kong. For users in the United States, disputes will be resolved by binding individual arbitration under the JAMS consumer arbitration rules, and class actions are waived. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@chat94.com with the subject line "Arbitration Opt-Out."

For consumers in the European Union, the United Kingdom, and other jurisdictions with mandatory consumer-protection rules, you retain your home-country statutory rights and forum. Nothing in this section overrides those rights.
